Terms and Conditions

Please read these terms and conditions carefully before booking a tour with Discover Ishigaki. By booking a tour with us, you agree to be bound by the following terms and conditions:

1. Booking and Payment

1.1. Tour Reservation: To reserve a tour, you must complete our booking form and provide all necessary information as requested. By submitting the booking form, you confirm that you have read, understood, and agreed to these terms and conditions.

1.2. Tour Confirmation: Upon receiving your booking form, we will send you a booking confirmation and itinerary details. Please review the details carefully and notify us immediately if you find any discrepancies.

1.3. Payment: Full payment is required by the end of the tour, unless otherwise specified. We accept payment via ash only, and all prices are listed in Japanese Yen (JPY). Any additional costs incurred during the tour, such as optional activities or personal expenses, are your responsibility.

2. Cancellation and Refunds

All our tours are dependent on weather conditions such as strong winds, Typhoons and heavy rain.
We will do our best to notify at least 60 minutes before the tour starts about any changes due to adverse weather conditions. Changes could include change of location, postponement or cancellation.

2.1. Cancellation by You: If you wish to cancel your tour, you must notify us in writing. The following cancellation fees will apply:

– Cancellation the day before: 50% of the tour fee.
– Cancellation on the day or not showing up in the morning: 100% of the tour fee will be charged!.

Please note that certain tours may have specific cancellation policies, which will be communicated to you at the time of booking.

2.2. Changes or Cancellation by Us: We reserve the right to modify or cancel a tour due to unforeseen circumstances, such as weather conditions, natural disasters, or insufficient bookings. 

In the event of deciding it is not safe to operate the tour due to adverse weather conditions, we may propose you to postpone or cancel the tour. This decision is to be made by Discover Ishigaki and we will do our best to notify our guests as soon as possible, more precisely at least 60 minutes prior the tour.

In case of cancellation by Discover Ishigaki the tour will be fully reimbursed.

3. Travel Documents and Responsibilities

3.1. Travel Documents: It is your responsibility to ensure that you have valid passports, visas, and any other required travel documents for the duration of the tour. We will not be held liable for any issues arising from the lack of proper documentation.

3.2. Health and Fitness: Some tours may require a certain level of physical fitness or have specific health requirements. It is your responsibility to assess your suitability for the tour and consult with your healthcare provider, if necessary.

3.3. Travel Insurance: We strongly recommend that you obtain comprehensive travel insurance to cover any unforeseen events, including trip cancellation, medical emergencies, and loss of personal belongings.

4. Tour Itinerary and Changes

4.1. Itinerary Changes: We reserve the right to make changes to the tour itinerary, including transportation, and activities, as necessary. We will make reasonable efforts to inform you of any significant changes before the tour commences.

4.2. Unused Services: No refunds or compensation will be provided for any unused portion of the tour, including meals, or activities, due to your late arrival, early departure, or any other personal reasons.

5. Liability and Limitations

5.1. Limitation of Liability: While we take all reasonable precautions to ensure your safety and satisfaction during the tour, we shall not be liable for any injury, loss, damage, delay, or inconvenience caused by any act or omission beyond our control, including but not limited to transportation services, weather conditions, or actions of third parties.

5.2. Indemnification: You agree to indemnify and hold Discover Ishigaki, its directors, employees, agents, and affiliates harmless from and against any claims, damages, liabilities, costs, and expenses arising out of or in connection with your participation in the tour, including but not limited to personal injury, property damage, or any other loss or harm.

5.3. Force Majeure: We shall not be held responsible for any failure or delay in performing our obligations under these terms and conditions due to events beyond our reasonable control, including but not limited to acts of God, natural disasters, war, civil unrest, or government actions.

6. Privacy and Data Protection

6.1. Personal Data: By booking a tour with us, you consent to the collection, use, and processing of your personal data in accordance with our privacy policy. We will handle your personal information in a confidential manner and only use it for the purpose of providing the tour services and communicating with you.

7. Governing Law and Jurisdiction

7.1. These terms and conditions shall be governed by and construed in accordance with the laws of Japan. Any disputes arising out of or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the courts of Japan.

8. Severability

8.1. If any provision of these terms and conditions is deemed invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

9. Entire Agreement

9.1. These terms and conditions constitute the entire agreement between you and Discover Ishigaki regarding the tour services and supersedes any prior agreements or understandings, whether written or oral.
